SUBJECT: DIRECTIVE REGARDING THE REGULARIZATION OF SCHOOLS
GUARDS (BPS-01) UNDER THE PUNJAB REGULARIZATION SERVICE ACT 2018.

VII. School guards were not recruited under the provisions of the Punjab Civil
Servant, 1974. They were temporarily involved in the aftermath of the tragedy
Army Public Schools in 2014 under Special Recruitment Policy 2015
which was notified by the Department of Education vide No.SO(SE-IV)
2-13/2014 dated 17.03.2015.
VIII. There is no permanent school guard position. Therefore they cannot be
modified as per Rules/Policies.
IX. The post is not reflected in “The Punjab School Education Department School Education Service Rules, 2014” nor in “The Punjab Education”. Department (School Education), Recruitment Rules, 1989″.
X. According to § 3 paragraph 2 letter (a) of the Punjab Services Regulation Act, 2018 as
amended, a regular vacancy is mandatory for the settlement of any contract
employee. In the given case, there is no vacancy for school guard. §3 paragraph 2 letter a) of the Act in the same place is reproduced as follows:
CS scanned with CamScanner. (2) Not with standing anything contained in the Act, contract employees who shall serve continuously as such for a period of not less than three years are eligible to be considered for appointment on a regular basis if:
(b) Regular vacancy allotted for initial recruitment is available for
regulation.”
The school superintendent’s agreement letter also states that retirement benefits
will not be allowed to the said place and general provident fund or contributory provident fund will not be deducted. Regularization of school guards without the support of Rules/Policy will open flood gate for such illegal regularization. Therefore, the school guard cannot be regulated by law and policy.
